As Fox News reports, the plaintiff in the Supreme Court case that overturned the District of Columbia’s unconstitutional handgun ban has filed a new federal lawsuit against the city. Dick Heller and two other plaintiffs claim that the city’s new gun regulations still violate their self defense rights, as guaranteed by the constitution:The new lawsuit cites the District of Columbia’s ban on firearms that carry more than 12 rounds of ammunition, which includes most ordinary semiautomatic handguns. The suit also claims that the city’s regulations make it all but impossible for residents to keep a gun ready for immediate self defense in the home, which is a constitutional right.
It is truly amazing that the D.C. politicians would pass a replacement gun law that continues to infringe the Second Amendment, right after the Supreme Court struck down their previous unconstitutional gun ban. Hopefully this lawsuit, and the proposed District of Columbia Personal Protection Act, will restore the rights of law abiding D.C. residents to defend themselves. I also sincerely hope that the remaining handgun bans, in cities such as Chicago and Oak Park are swiftly struck down as well, since it is clear that such bans only serve to disarm the law abiding citizens, making them more vulnerable to illegal-gun-toting criminals.
