As reported, District Court judge Milton Shadur upheld the Chicago handgun ban.
However this should not be seen as truly bad news. The District Court judge stated that he felt bound by a previous 7th Circuit Court of Appeals ruling that upheld the ban. As the NRA liaison for Illinois stated, “[i]t was expected. We went to court knowing it’s going to take a higher court’s ruling [to get the unconstitutional handgun ban overturned].” Simply put, the trial court judge was afraid to stick his neck out and interpret the D.C. v. Heller opinion in a way that would be contrary to the 7th Circuit Court of Appeals’ rulings – even when those rulings came years before the Supreme Court heard D.C. v. Heller.
Upon hearing the news, Mayor Daley claimed victory and went on to repeat several baseless anti gun statements that he made months ago.
